{"id":1181,"date":"2026-05-07T07:04:32","date_gmt":"2026-05-07T07:04:32","guid":{"rendered":"https:\/\/mywarmhome.co.uk\/newsite\/?p=1181"},"modified":"2026-05-12T10:42:51","modified_gmt":"2026-05-12T10:42:51","slug":"awaabs-law","status":"publish","type":"post","link":"https:\/\/mywarmhome.co.uk\/newsite\/2026\/05\/07\/awaabs-law\/","title":{"rendered":"Awaab\u2019s Law"},"content":{"rendered":"\n<h1 class=\"wp-block-heading\">Awaab\u2019s Law: What Social Housing Tenants &amp; Landlords Need to Know (And Why It Matters for Damp, Mould &amp; Energy Efficiency)<\/h1>\n\n\n\n<p>From <strong>October 2025<\/strong>, a major new rule comes into force for social housing in England: <a href=\"https:\/\/www.gov.uk\/government\/publications\/awaabs-law-guidance-for-social-landlords\/awaabs-law-guidance-for-social-landlords-timeframes-for-repairs-in-the-social-rented-sector\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Awaab\u2019s Law<\/strong><\/a>.<br>It\u2019s one of the biggest changes to tenant safety and housing quality in years, and it was introduced after the tragic death of two year old <strong>Awaab Ishak<\/strong>, who died in 2020 from prolonged exposure to mould in his home.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">This Law is designed to make sure this never happens again.<\/h2>\n\n\n\n<p>In this post, we cover what the new law means, how it affects landlords, what tenants can expect, and why it directly links to issues we discuss regularly.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Is Awaab\u2019s Law?<\/h2>\n\n\n\n<p>Awaab\u2019s Law is a legal requirement for <strong>social landlords<\/strong> (housing associations and councils) to <strong>respond quickly<\/strong> when tenants report <strong>damp, mould, or other serious hazards<\/strong>. It Should be rolled out to private landlords in the near future.<\/p>\n\n\n\n<p><em>It introduces strict, legally enforceable timeframes for.<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Investigating reported hazards,<\/li>\n\n\n\n<li>Making the property safe,<\/li>\n\n\n\n<li>Providing written updates to tenants,<\/li>\n\n\n\n<li>Offering alternative accommodation if necessary,<\/li>\n<\/ul>\n\n\n\n<p>For decades, damp and mould issues were too often dismissed as \u201clifestyle problems\u201d.<br>Awaab\u2019s Law formally ends that.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Key issues social Landlords Must adhere to are.<\/h2>\n\n\n\n<p>1. Damp &amp; Mould Hazards.<\/p>\n\n\n\n<p>2. Emergency Hazards.<\/p>\n\n\n\n<p>These key issues will be <strong>automatically written into all social housing tenancy agreements<\/strong>.<br>If a landlord doesn\u2019t comply, tenants can take legal action or escalate complaints to the&nbsp;<a href=\"https:\/\/www.housing-ombudsman.org.uk\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Housing Ombudsman<\/strong>.<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Awaab\u2019s Law Matters for Energy-Efficiency &amp; mould most commonly occur when:<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/mywarmhome.co.uk\/newsite\/newsite\/insulation\/\" data-type=\"page\" data-id=\"286\">insulation<\/a> is poor.<\/li>\n\n\n\n<li><a href=\"https:\/\/mywarmhome.co.uk\/newsite\/newsite\/ventilation\/\" data-type=\"page\" data-id=\"516\">ventilation<\/a> is inadequate.<\/li>\n\n\n\n<li>heating is inconsistent or too expensive.<\/li>\n\n\n\n<li>building fabric is damaged.<\/li>\n\n\n\n<li>retrofit work was done badly.<\/li>\n\n\n\n<li><a href=\"https:\/\/mywarmhome.co.uk\/newsite\/newsite\/ventilation\/\" data-type=\"page\" data-id=\"516\">extractor<\/a> fans don\u2019t work.<\/li>\n\n\n\n<li>air can\u2019t escape after insulation works.<\/li>\n<\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-accent-5-color has-custom-color-1-background-color has-text-color has-background has-link-color wp-elements-f2a4590e1e8b1d567c03a1754f416a9f\">This is why the law matters beyond repairs,\u00a0it encourages better maintenance, better design, and higher standards across insulation and ventilation systems.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\">Better insulation + better ventilation = fewer mould cases.<\/h2>\n\n\n\n<p><em>Awaab\u2019s Law may push more landlords to:<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>upgrade ventilation systems to meet households needs.<\/li>\n\n\n\n<li>improve insulation correctly and professionally<\/li>\n\n\n\n<li>fix construction defects timely.<\/li>\n\n\n\n<li>install appropriate heating that can hopefully be afforded by tenants.<\/li>\n\n\n\n<li>ensure post-retrofit checks are done correctly by <a href=\"https:\/\/mywarmhome.co.uk\/newsite\/2026\/03\/17\/installers\/\" data-type=\"post\" data-id=\"1437\">qualified personnel<\/a>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Healthy homes are energy-efficient homes and vice-versa.<\/h2>\n\n\n\n<p>What Tenants Should Do If They Spot Damp or <em>Moul<\/em>d.<\/p>\n\n\n\n<p>If you live in&nbsp;<strong>social housing<\/strong>&nbsp;(council or housing association), you have new legal protection.<\/p>\n\n\n\n<p><em>You should:<\/em><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Report the issue formally.\u00a0(email is best)<\/li>\n\n\n\n<li>Include photos and dates.\u00a0(try to use a GPS camera, lots of free ones on online)<\/li>\n\n\n\n<li>Keep copies of everything.<\/li>\n\n\n\n<li>Allow the landlord access for inspections.\u00a0(a good landlord will always have your best interest at heart, so try to oblige when they request access)<\/li>\n<\/ol>\n\n\n\n<p><em>If they don\u2019t meet the Awaab\u2019s Law time frames, you can escalate:<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Through the&nbsp;<a href=\"https:\/\/www.housing-ombudsman.org.uk\/residents\/how-to-complain-to-your-landlord\/\" target=\"_blank\" rel=\"noreferrer noopener\">landlord\u2019s complaints process.<\/a><\/li>\n\n\n\n<li>To the&nbsp;<a href=\"https:\/\/www.housing-ombudsman.org.uk\/residents\/how-to-complain-to-your-landlord\/\" target=\"_blank\" rel=\"noreferrer noopener\">Housing Ombudsman.<\/a><\/li>\n\n\n\n<li>or through the courts (<a href=\"https:\/\/england.shelter.org.uk\/professional_resources\/legal\/housing_conditions\/responsibility_for_repairs\/fitness_for_habitation_in_rented_homes\" target=\"_blank\" rel=\"noreferrer noopener\">breach of tenancy obligations<\/a>)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Social landlords must now:<\/em><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Have a\u00a0damp &amp; mould action plan.<\/li>\n\n\n\n<li>Update repairs procedures<\/li>\n\n\n\n<li>Train staff on moisture, ventilation, and building fabric<\/li>\n\n\n\n<li>Monitor high-risk properties.<\/li>\n\n\n\n<li>Keep written communication with tenants.<\/li>\n\n\n\n<li>Ensure compliance with the new timeframes.<\/li>\n<\/ul>\n\n\n\n<p>This law requires a shift from \u201creactive repairs\u201d to\u00a0proactive housing management.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The law is going to change and will add phases over the years, including,<\/h2>\n\n\n\n<p><strong>Phase 2 (2026\u20132027)<\/strong><\/p>\n\n\n\n<p>Will likely expand to include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Managing excess heat and cold.<\/li>\n\n\n\n<li>Identification of electrical\/fire risks.<\/li>\n\n\n\n<li>Identification of structural problems.<\/li>\n\n\n\n<li>Identification of hygiene hazards.<\/li>\n<\/ul>\n\n\n\n<p>This will raise the baseline standard for social housing significantly.<\/p>\n\n\n\n<p>Whether you\u2019re a tenant, a homeowner, or researching Warmhomes\/BUS\/solar\/insulation upgrades, the message is the same:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-accent-5-color has-custom-color-1-background-color has-text-color has-background has-link-color wp-elements-ed7bbc329b8ed1b1fe296365d7103e53\">A home must be\u00a0warm, dry, ventilated and safe.
