starts with action<\/h2>\n\n\n\n<p class=\"mwh-law-lead has-contrast-color has-text-color has-link-color wp-elements-1 wp-block-paragraph\">Social landlords in England now have legal deadlines to investigate significant damp and mould and make homes safe. Here is what tenants can expect, and why fixing the cause matters.<\/p>\n\n\n\n<p class=\"has-contrast-color has-text-color has-link-color wp-elements-2 wp-block-paragraph\">The law is named in memory of two-year-old Awaab Ishak, who died in 2020 after prolonged exposure to mould in his home. It covers <strong>all emergency hazards<\/strong> and, in its first phase, <strong>damp and mould hazards that present a significant risk of harm<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It applies to social housing tenancies in England, including homes let by councils and housing associations. Some temporary and supported accommodation is covered where it is occupied under a social housing tenancy; a licence arrangement may be different.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Phase 1 deadlines do not currently apply to ordinary private tenancies or owner-occupied homes. Other duties to maintain safe housing can still apply.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<div class=\"wp-block-group mwh-law-note is-layout-flow wp-block-group-is-layout-flow\">\n<h3 class=\"wp-block-heading\">Risk depends on the people living there<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A landlord must consider the hazard and the circumstances of the household. For example, a young child or someone with a respiratory illness can affect how serious or urgent a damp and mould problem is.<\/p>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Report any damp or mould.<\/strong> The landlord has to assess it; tenants do not need to decide whether it meets a legal threshold before reporting it.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group mwh-law-section is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-group mwh-law-inner is-layout-flow wp-block-group-is-layout-flow\">\n<p class=\"mwh-law-eyebrow wp-block-paragraph\">02 \/ What the landlord must do<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Investigate, explain and make the home safe<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The timescales begin when the landlord becomes aware of a potential hazard. If that cannot be done in time, offer suitable temporary accommodation.<\/p>\n<\/div>\n<\/div>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>After the immediate danger:<\/strong> work needed to prevent the hazard returning must begin, or steps to begin it must be taken, within 5 working days of the investigation ending. Where it cannot start immediately, it must start as soon as reasonably practicable and within 12 weeks.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group mwh-law-section mwh-law-dark has-custom-color-1-background-color has-background is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-group mwh-law-inner is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-columns mwh-law-grid is-layout-flex wp-container-core-columns-is-layout-794e3cfa wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p class=\"mwh-law-eyebrow wp-block-paragraph\">03 \/ Finding the cause<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why does the damp or mould keep coming back?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Removing visible mould can be a useful first step, but a lasting repair depends on finding the source. The cause might be a leak, rain penetration, a cold wall, insufficient heating or ventilation that does not remove enough moisture. Several problems can occur together.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Government guidance explicitly warns landlords against assuming damp and mould are caused by a tenant\u2019s \u201clifestyle\u201d. Cooking, bathing and drying laundry produce moisture in any occupied home; these everyday activities are not, by themselves, a reason to avoid investigating.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<div class=\"wp-block-group mwh-law-note has-accent-5-color has-custom-green-background-color has-text-color has-background has-link-color wp-elements-7 is-layout-flow wp-block-group-is-layout-flow\">\n<h3 class=\"wp-block-heading has-contrast-color has-text-color has-link-color wp-elements-8\">Look at the whole home<\/h3>\n\n\n\n<p class=\"has-contrast-color has-text-color has-link-color wp-elements-9 wp-block-paragraph\">Check the building as a system, including water ingress, cold surfaces, heating and ventilation.<\/p>\n<\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Check gutters, roofs, plumbing and other sources of water ingress.<\/li>\n\n\n\n<li>Check cold surfaces, thermal bridges and insulation gaps.<\/li>\n\n\n\n<li>Check bathroom and kitchen extraction and the path for replacement air.<\/li>\n\n\n\n<li>Check whether heating is effective and affordable to use.<\/li>\n\n\n\n<li>Check whether earlier retrofit work changed airflow or moisture behaviour.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where a landlord-controlled deficiency such as missing ventilation or poor insulation causes a hazard, the guidance says the landlord must address that underlying cause.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group mwh-law-section is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-group mwh-law-inner is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-columns mwh-law-grid is-layout-flex wp-container-core-columns-is-layout-794e3cfa wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p class=\"mwh-law-eyebrow wp-block-paragraph\">04 \/ For tenants<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What to do when you spot damp or mould<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Report it promptly through your landlord\u2019s repairs route. For an urgent danger, use the emergency reporting route or phone number. Explain where the problem is, how long it has been there and whether anyone in the household has health needs that may increase the risk.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Make a clear report.<\/strong> Give the location, the extent of the problem, any leaks or broken fans and the date you first noticed it.<\/li>\n\n\n\n<li><strong>Keep a record.<\/strong> Save dated photos, your report reference and copies of messages. You do not need a special camera app.<\/li>\n\n\n\n<li><strong>Help arrange access.<\/strong> Agree a practical inspection time and tell the landlord about any access needs.<\/li>\n\n\n\n<li><strong>Ask what happens next.<\/strong> Request the investigation findings, safety work plan and dates in writing.<\/li>\n<\/ol>\n<\/div>\n\n\n\n<div class=\"wp-block-column has-custom-color-1-background-color has-background is-layout-flow wp-block-column-is-layout-flow\">\n<div class=\"wp-block-group mwh-law-note is-layout-flow wp-block-group-is-layout-flow\">\n<h3 class=\"wp-block-heading\">If the landlord does not act<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Use the landlord\u2019s complaints process. After its final response, or where the complaint is otherwise eligible, you can contact the <a href=\"https:\/\/www.housing-ombudsman.org.uk\/residents\/make-a-complaint\/\">Housing Ombudsman<\/a>. A repair logged as \u201cmould on a bedroom wall\u201d may point to a roof leak, a ventilation failure or a cold surface elsewhere in the building.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Make the home safe within the relevant deadline, then arrange the necessary work to stop the hazard recurring. Good ventilation removes everyday moisture. Effective heating helps maintain comfort. These systems need to work together, especially after a home has been made more airtight.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Improving one measure without checking the others can leave damp, condensation or cold spots unresolved.
