For social landlords, it means the condition of the building, heating, insulation, ventilation and other elements may need to be considered together rather than treating an individual repair in isolation.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull mwh2-post-content has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"padding-top:0;padding-bottom:0\">\n<div class=\"wp-block-group mwh2-post-reading has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n<h2 class=\"wp-block-heading\">What is Awaab\u2019s Law?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Awaab\u2019s Law was introduced following the death of two-year-old <strong>Awaab Ishak<\/strong>, who died in 2020 following prolonged exposure to mould in his social housing home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His family had repeatedly raised concerns about the condition of their property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legislation creates legally enforceable timeframes requiring social landlords to investigate serious hazards and take appropriate action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tenants may ultimately take legal action where a landlord fails to comply with its obligations.<\/p>\n\n\n\n<div class=\"wp-block-group mwh2-post-stat has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"mwh2-post-stat-number wp-block-paragraph\">30.11.26<\/p>\n\n\n\n<p class=\"mwh2-post-stat-copy wp-block-paragraph\">Phase 2 of Awaab\u2019s Law begins on 30 November 2026.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-group mwh2-post-image has-global-padding cover?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Phase 2 significantly expands the types of <strong>significant hazards<\/strong> covered by the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From 30 November 2026 these will include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><a href=\"https:\/\/mywarmhome.co.uk\/stage\/damp-and-mould\/\" data-type=\"page\" data-id=\"516\">Damp and mould<\/a><\/strong><\/li>\n\n\n\n<li><strong>Excess cold<\/strong><\/li>\n\n\n\n<li><strong>Excess heat<\/strong><\/li>\n\n\n\n<li><strong>Falls<\/strong>, including falls on level surfaces, stairs and between levels<\/li>\n\n\n\n<li><strong>Structural collapse and falling elements<\/strong><\/li>\n\n\n\n<li><strong>Fire and explosions<\/strong><\/li>\n\n\n\n<li><strong>Electrical hazards<\/strong><\/li>\n\n\n\n<li><strong>Domestic hygiene<\/strong>, including personal hygiene and food safety<\/li>\n<\/ul>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull mwh2-post-content has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"padding-top:0;padding-bottom:0\">\n<div class=\"wp-block-group mwh2-post-reading has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n<h2 class=\"wp-block-heading\">Emergency hazards \u2014 24 hours<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">An emergency hazard is effectively one where the circumstances indicate an imminent and significant risk to the occupant and rapid action is required.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Examples could potentially include serious electrical dangers, major structural risks, severe heating failures affecting a vulnerable resident or an immediate fire hazard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each situation has to be assessed individually.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The circumstances of the resident matter<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Age, disability, health conditions and other vulnerabilities can affect how urgently a hazard needs to be treated.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Written findings matter too<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Following the investigation, the landlord must provide the tenant with a written summary within three working days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legislation therefore places greater emphasis on communication and record keeping as well as physical repairs.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull mwh2-post-feature-band has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"padding-top:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30)\">\n<div class=\"wp-block-group mwh2-post-feature-inner has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"mwh2-label mwh2-label-light wp-block-paragraph\">THE IMPORTANT DISTINCTION<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-base-color has-text-color has-link-color wp-elements-9\">Fixing the cause not just the symptoms.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most important aspects of Awaab\u2019s Law is the distinction between <strong>making the property safe<\/strong> and <strong>preventing the hazard from happening again.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once a hazard has been identified, landlords may also have to carry out supplementary preventative work.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where possible, that work should begin within five working days of the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where this is not reasonably practicable because specialist contractors, surveys, materials or approvals are required, steps towards the work may need to begin within that period and the work itself begin as soon as reasonably practicable and within the permitted longer period.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote mwh2-quote has-custom-color-1-background-color has-background is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-base-color has-text-color has-link-color wp-elements-10 wp-block-paragraph\"><strong>Making something temporarily safe does not necessarily remove the responsibility to deal with the reason the hazard occurred.<\/strong><\/p>\n<\/blockquote>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull mwh2-post-content has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"padding-top:0;padding-bottom:0\">\n<div class=\"wp-block-group mwh2-post-reading has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n<h2 class=\"wp-block-heading\">Damp and mould is a good example<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine mould repeatedly forming on the external wall of a bedroom.<br>Simply washing the mould away may remove the immediate visible problem.<br><strong>But why is it happening?<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The cause could include:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/mywarmhome.co.uk\/stage\/ventilation\/\" data-type=\"page\" data-id=\"516\">Inadequate ventilation<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/mywarmhome.co.uk\/stage\/insulation\/\" data-type=\"page\" data-id=\"1575\">Missing or poorly performing insulation<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/mywarmhome.co.uk\/stage\/u-values\/\" data-type=\"post\" data-id=\"1807\">Thermal bridging<\/a><\/li>\n\n\n\n<li>Water penetration<\/li>\n\n\n\n<li>Leaking gutters or roof coverings<\/li>\n\n\n\n<li>Defective pointing<\/li>\n\n\n\n<li>Plumbing leaks<\/li>\n\n\n\n<li>Insufficient heating<\/li>\n\n\n\n<li>A combination of several factors<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where damp and mould results from missing ventilation or poor insulation, appropriate remedial work may therefore involve more than cleaning the visible mould.<\/p>\n\n\n\n<div class=\"wp-block-group mwh2-post-image has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n<figure class=\"wp-block-image size-large\" has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"mwh2-label wp-block-paragraph\">EXCESS COLD<\/p>\n\n\n\n<h2 class=\"wp-block-heading mwh2-post-summary-title\">A working boiler does not automatically mean a warm home.<\/h2>\n\n\n\n<p class=\"mwh2-post-standfirst wp-block-paragraph\">For those working in energy efficiency and retrofit, excess cold could be one of the most important additions in Phase 2.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull mwh2-post-content has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"padding-top:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30)\">\n<div class=\"wp-block-group mwh2-post-reading has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"wp-block-paragraph\">A property may have a working boiler or heat pump and still be excessively cold.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The problem could relate to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Insufficient loft insulation<\/li>\n\n\n\n<li>Poorly insulated walls<\/li>\n\n\n\n<li>Significant thermal bridging<\/li>\n\n\n\n<li>Draughts<\/li>\n\n\n\n<li>Defective windows or doors<\/li>\n\n\n\n<li>Inadequate heating provision<\/li>\n\n\n\n<li>Poorly designed heating controls<\/li>\n\n\n\n<li>High heat loss<\/li>\n\n\n\n<li>Moisture within the building fabric<\/li>\n<\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">A repair-only approach may therefore fail to identify the real problem.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\">Ventilation must not be forgotten<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Improving insulation and reducing uncontrolled air leakage can make homes warmer and more efficient. But moisture still has to leave the building. Cooking, showering, washing clothes and simply breathing all release moisture into the home.<br>Where insulation is improved, ventilation should therefore be assessed alongside it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">That could include checking:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Bathroom extract ventilation<\/li>\n\n\n\n<li>Kitchen extraction<\/li>\n\n\n\n<li>Background ventilation<\/li>\n\n\n\n<li>Trickle vents<\/li>\n\n\n\n<li>Airflow between rooms<\/li>\n\n\n\n<li>Existing mechanical ventilation<\/li>\n\n\n\n<li>Signs of condensation<\/li>\n\n\n\n<li>Internal humidity<\/li>\n\n\n\n<li>Cold surface temperatures<\/li>\n<\/ul>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull mwh2-post-content has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"border-style:none;border-width:0px;padding-top:0;padding-bottom:0\">\n<div class=\"wp-block-group mwh2-post-reading has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group mwh2-post-alert has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"mwh2-label wp-block-paragraph\">IMPORTANT DISTINCTION<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-base-color has-text-color has-link-color wp-elements-11\">Phase 2 is not currently the same rule for ordinary private landlords.<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Phase 2 rules beginning on 30 November 2026 apply to the social rented sector in England, including registered providers such as councils and housing associations.<\/p>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">They do not currently apply in the same way to ordinary privately rented or owner-occupied homes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The government has separately indicated its intention to extend Awaab\u2019s Law-style protections into the private rented sector, but that is a separate process.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What if the home cannot be made safe?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If required safety work cannot be completed within the statutory timeframe, the landlord may have to arrange <strong>suitable alternative accommodation at its own expense<\/strong> until the property can be made safe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is another reason why good inspection, triage and repair systems are becoming increasingly important.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What should social landlords be doing now?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Housing providers have a considerable amount to prepare for.<br>Repair systems need to recognise potential Awaab\u2019s Law cases quickly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Staff receiving calls, carrying out inspections or visiting homes need to understand that what initially appears to be a routine repair could indicate a significant hazard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Organisations should also consider how information is captured and retained as they move towards a more holistic approach to
